General Terms and Conditions of Intermediary Services

Preamble

Meeting Point Hotel Management Malta Ltd, with its registered office at Level 7, Building SCM 02/03, Smart City, Malta SCM 1001, Malta (hereinafter referred to as the "Company"), offers on this internet portal intermediary services for various accommodation services provided by different accommodation service providers.

The following conditions apply to the intermediary services provided by the Company for accommodation services of the respective service providers.

Please also note the respective General Terms and Conditions (travel and payment conditions) as well as pre-contractual information provided by the responsible service provider in the service description.

I. Contents of Contract, Conclusion of Contract

  1. An agency contract is concluded between the customer and the Company. The customer instructs the Company to arrange excursions or other travel services offered by the respective service provider. The Company acts solely as an agent for the services offered and does not offer or provide the services in its own name.
  2. The offers presented by the Company on the aforementioned internet portal do not represent a binding offer by the Company or the respective service provider. By entering their data and sending the online booking form to the Company, the customer submits a binding contract offer to the respective service provider and simultaneously instructs the Company to perform intermediary services.
  3. After sending the booking form, the customer will receive a booking confirmation via email, sent to the email address provided by them, which confirms the booking order.
  4. The reservation number will be sent with the booking confirmation for presentation to the corresponding service provider.
  5. The customer shall immediately check the accuracy of any confirmation sent to them by the Company and inform the Company of any discrepancies to avoid any potential issues.

II. Payment

The payment for the booked services must be made in accordance with the payment information provided during the online booking process or in the booking form.

III. Limitation of Liability

The Company’s liability for damages not resulting from injury to life, body, or health is limited to typically foreseeable damage, up to the total price of the arranged excursion service per person, provided that the damage is not caused by intent or gross negligence and does not pertain to obligations whose fulfillment is essential for the proper execution of the contract and on which the customer regularly relies. This limitation of liability does not apply to claims under the Product Liability Act or any other statutory guarantee liability.

IV. Notes on Obligations of the Customer

The customer is advised that the general terms and conditions (travel and payment conditions) of the service provider may establish specific obligations for the customer.

V. Shortening of the Limitation Period

  1. The customer’s claims against the Company arising from the intermediary contract, deviating from legal regulations, become statute-barred within one year unless the damages result from injury to life, body, or health, or from a grossly negligent breach of duty by the Company or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the Company.
  2. The limitation period begins at the end of the year in which the claim arose, and the customer becomes aware or should have become aware of the circumstances substantiating the claim and the person of the debtor without gross negligence.

VI. Consumer Arbitration Board / OS Platform

  1. The Company is not obliged to participate in dispute resolution proceedings before a consumer arbitration board and does not participate in such proceedings.
  2. The Company hereby draws the customer’s attention to the platform operated by the EU Commission at http://ec.europa.eu/consumers/odr/ for the online settlement of consumer disputes.

VII. Final Provisions

The place of performance is the registered office of the Company.
